Visa: the surcharge “must not exceed your cost of acceptance for the credit card”, and where that cost is above 3% the merchant “cannot assess a surcharge above 3%”. Mastercard caps the surcharge at the lesser of your Mastercard credit merchant discount rate or 4%. Visa requires merchants to notify their acquirer (processor) 30 days before surcharging. Federal law on cash discounts关于现金折扣的联邦法律Ley federal sobre descuentos por efectivo
Under 15 U.S.C. § 1693o-2(b)(2), a payment card network may not stop a merchant from offering a discount for payment by cash, check, debit card or credit card, provided the discount does not differentiate by issuer or network and, to the extent required by federal and state law, is offered to all prospective buyers and disclosed clearly and conspicuously. A discount has to be a real reduction from the price you post. Surcharges are prohibited for any payment method. Since February 11, 2024, a business may pass along no more than its actual card processing cost and must clearly post the total credit card price before the sale. Posting both a card price and a cash price is legal. Since July 1, 2022, a merchant may charge up to 2% of the transaction or its actual cost to process that transaction. Visa's merchant guidance (version dated August 14, 2023) names Connecticut, Maine, Massachusetts and Oklahoma as states “currently prohibiting or limiting surcharging”.
